We continue our look at African Americans in the Revolution with….

Elizabeth Freeman aka “Mum Bett”

Elizabeth Freeman, in early life known as Bett and later Mum Bett (c.1742 – December 28, 1829), was among the first black slaves in Massachusetts to file a “freedom suit” and win in court under the 1780 constitution, with a ruling that slavery was illegal. Her county court case, Brom and Bett v. Ashley, decided in August 1781, was cited as a precedent in the Massachusetts Supreme Judicial Court appeal review of Quock Walker‘s “freedom suit”. When the state Supreme Court upheld Walker’s freedom under the constitution, the ruling was considered to have informally ended slavery in the state.

Biography and trial

Elizabeth Freeman was illiterate and left no written records of her life. Her early history has been pieced together from the writings of contemporaries to whom she told her story or who heard it indirectly, as well as from historical records.[2][3]

Freeman was born into slavery about 1742 at the farm of Pieter Hogeboom in Claverack, New York, where she was given the name Bett. When his daughter Hannah married John Ashley of Sheffield, Massachusetts, Hogeboom gave Bett, then in her early teens, to them. She remained with them until 1781, during which time she married and had a child, Betsy. Her husband (name unknown, marriage unrecorded) never returned from service in the Revolutionary War.[4]

Throughout her life, Bett exhibited a strong spirit and sense of self. She came into conflict with Hannah Ashley, who was raised in the strict Dutch culture of the New York colony. In 1780, Bett prevented Hannah from striking her daughter Betsy[Notes 1] with a heated shovel, but Elizabeth shielded her daughter and received a deep wound in her arm. As the wound healed, Bett left it uncovered as evidence of her harsh treatment.[1] Catharine Maria Sedgwick quotes Elizabeth saying, “Madam never again laid her hand on Lizzy[sic]. I had a bad arm all winter, but Madam had the worst of it. I never covered the wound, and when people said to me, before Madam, “Betty, what ails your arm?” I only answered – ‘ask missis!’ Which was the slave and which was the real misses?”[1]

John Ashley was a Yale-educated lawyer, wealthy landowner, businessman and leader in the community. His house was the site of many political discussions and the probable location of the signing of the Sheffield Resolves, which predated the Declaration of Independence.

Soon after the Revolutionary War, Freeman heard the constitution read at Sheffield and these words[1]:

All men are born free and equal, and have certain natural, essential, and unalienable rights; among which may be reckoned the right of enjoying and defending their lives and liberties; that of acquiring, possessing, and protecting property; in fine, that of seeking and obtaining their safety and happiness.

Bett sought the counsel of Theodore Sedgwick, a young abolition-minded lawyer, to help her sue for freedom in court. She told him, “I heard that paper read yesterday, that says, all men are created equal, and that every man has a right to freedom. I’m not a dumb critter; won’t the law give me my freedom?”[1] Sedgwick willingly accepted her case, as well as that of Brom, another of Ashley’s slaves. He enlisted the aid of Tapping Reeve, the founder of America’s first law school, located at Litchfield, Connecticut.

The case of Brom and Bett vs. Ashley was heard in August 1781 before the County Court of Common Pleas in Great Barrington.[5] Sedgwick and Reeve asserted that the constitutional provision that “all men are born free and equal” effectively abolished slavery in the state. When the jury ruled in Bett’s favor, she became the first African-American woman to be set free under the Massachusetts state constitution.

The jury found that “…Brom & Bett are not, nor were they at the time of the purchase of the original writ the legal Negro of the said John Ashley…”[6] The court assessed damages of thirty shillings and awarded both plaintiffs compensation for their labor.

After the ruling, Bett took the names Elizabeth Freeman. Although Ashley asked her to return to his house and work for wages, she chose to work in her attorney Sedgwick’s household. She worked for his family until 1808 as senior servant and governess to the Sedgwick children, who called her “Mum Bett”. Also working at the Sedgwick household during much of this time was Agrippa Hull, a free black who had served for years during the Revolutionary War.[7][8]

The Sedgwick children included Catharine Sedgwick, who became a well-known author and wrote an account of her governess’ life. From the time Elizabeth Freeman gained her freedom, she became widely recognized and in demand for her skills as a healer, midwife and nurse. After the Sedgwick children were grown, Freeman and her daughter bought and moved into their own house in Stockbridge.

Death

Freeman’s real age was never known, but an estimate on her tombstone puts her age at about 85. She died in December of 1829 and was buried in the Sedgwick family plot in Stockbridge, Massachusetts. They provided a tombstone, inscribed as follows:

ELIZABETH FREEMAN, known by the name of MUMBET died Dec. 28th 1829. Her supposed age was 85 Years. She was born a slave and remained a slave for nearly thirty years. She could neither read nor write, yet in her own sphere she had no superior or equal. She neither wasted time nor property. She never violated a trust, nor failed to perform a duty. In every situation of domestic trial, she was the most efficient helper and the tenderest friend. Good mother, farewell.[2]

Legacy

The decision in the case of Elizabeth Freeman was cited as precedent when the State Supreme Judicial Court heard the appeal of Quock Walker v. Jennison. Walker’s freedom was upheld. These cases set the legal precedents that ended slavery in Massachusetts. Vermont had already abolished it explicitly in its constitution.[2][3][9][10]

Connection to W.E.B. Du Bois

Historian W.E.B. Du Bois claimed Freeman as his relative and wrote that she married his maternal great-grandfather, “Jack” Burghardt.[11][12] But, Freeman was 20 years senior to Burghardt, and no record of such a marriage has been found. It may have been Freeman’s daughter, Betsy Humphrey, who married Burghardt after her first husband, Jonah Humphrey, left the area “around 1811″, and after Burghardt’s first wife died (c. 1810). If so, Freeman would have been Du Bois’s step-great-great-grandmother. Anecdotal evidence supports Humphrey’s marrying Burghardt; a close relationship of some form is likely.[2]

    For Daughters of the American Revolution, a New Chapter

    Olivia Cousins can trace her family in the United States to a soldier who joined the rebelling colonists when he was just 17. But when a friend suggested she join the Daughters of the American Revolution, an organization whose members can prove they are related to someone who aided the rebels in 1776, Dr. Cousins nearly laughed.

    Dr. Cousins is black. And the D.A.R., as it is commonly called, is a historically white organization with a record of excluding blacks so ugly that Eleanor Roosevelt renounced her membership in protest.

    Yet last week, in a circa-1857 stone chapel in Jamaica, Queens, Dr. Cousins was named an officer in a small ceremony establishing a new chapter. Her daughter took photos. The pictures documented a singular moment for the D.A.R., founded in 1890: 5 of the 13 members of the new chapter are black.

    When Republicans told us that they wanted to gut campaign finance laws, they said it wouldn’t matter, because they would support reporting and disclosure requirements. Sunshine is the best disinfectant. For anyone who relied on their solemn, heart-felt, good-government vows to support disclosure and reporting requirements, I got news for you.

    They all lied:
    During their long campaign to loosen rules on campaign money, conservatives argued that there was a simpler way to prevent corruption: transparency. Get rid of limits on contributions and spending, they said, but make sure voters know where the money is coming from.
    Today, with those fundraising restrictions largely removed, many conservatives have changed their tune. They now say disclosure could be an enemy of free speech.

    High-profile donors could face bullying and harassment from liberals out to “muzzle” their opponents, Sen. Minority Leader Mitch McConnell (R-Ky.) said in a recent speech. Corporations could be subject to boycotts and pickets, warned the Wall Street Journal editorial page this spring. Democrats “want to intimidate people into not giving to these conservative efforts,” said Republican strategist Karl Rove on Fox News. “I think it’s shameful.”

    Boycotts and pickets! In other words, corporations could be subject to political speech, in response to their political speech. The unfairness of it all! You mean, people get to… talk back under this liberal “free speech” scheme? Who knew? Is that in the Tea Party Constitution?

    “Disclosure is the one area where [conservatives] haven’t won,” said Richard Briffault, an election law professor at Columbia Law School. “This is the next frontier for them.

    Anti-abortion groups are leaders in suing to gut campaign finance, disclosure and reporting rules. Recently, anti-abortion groups targeted the state of Vermont’s laws regulating campaign finance and disclosure. They lost this round, but they’ll be back.

    - — -Republican presidential hopeful Mitt Romney’s finances are under renewed scrutiny thanks to a new report detailing how and where he accumulated his up to $250 million fortune as well as shining a light on where the money is stashed.

    A newly-released Vanity Fair article builds on Romney’s tax releases, which were made available earlier this year thanks to pressure from his GOP primary rivals. As previously noted over the course of the campaign, Romney wildly profited from his time as CEO of Bain Capital, a venture capital and investment firm, and still pulls in money from Bain thanks to his retirement package.

    In addition to paying a lower tax rate than most Americans—about 15 percent because most of his income is from investment rather than wages—he also has held offshore accounts in tax havens such as Switzerland and the Cayman Islands.

    More on some of Romney’s financial holdings, with some context:

    For nearly 15 years, Republican presidential candidate Mitt Romney’s financial portfolio has included an offshore company that remained invisible to voters as his political star rose.

    Based in Bermuda, Sankaty High Yield Asset Investors Ltd. was not listed on any of Romney’s state or federal financial reports. The company is among several Romney holdings that have not been fully disclosed, including one that recently posted a $1.9 million earning — suggesting he could be wealthier than the nearly $250 million estimated by his campaign.

    The omissions were permitted by state and federal authorities overseeing Romney’s ethics filings, and he has never been cited for failing to disclose information about his money. But Romney’s limited disclosures deprive the public of an accurate depiction of his wealth and a clear understanding of how his assets are handled and taxed, according to experts in private equity, tax and campaign finance law.

    When the Obama campaign starts running ads about this, Halperin will whine it’s class warfare and Glenn Kessler will give it Four Pinocchios. But how many divisions do they have?

    - –Chief Justice John Roberts is 62 years-old. If he serves as long as his former colleague John Paul Stevens, he will retire in 2043. I don’t expect Roberts to become a reliable vote for the liberal point of view on the Court, but anything that pushes him in that direction has to be considered a good thing. It doesn’t seem like he is currently welcome in the conservatives’ camp. I hope that continues. I’m sure the liberals will be happy to lunch with him today, tomorrow, and for the next few decades. Chief Justice Roberts is a human being, and he will seek positive rewards where he can find them. He may try to repair his damaged reputation with conservatives by overcompensating in future cases. Or, he may feel badly alienated and mistreated, and decide that his positive reinforcement comes from some other source. In either case, I encourage all Republicans to pile on Roberts with all the vituperative hatred and disrespect they can muster. Make life miserable for this man, please.

    Jonathan Krohn Laughs Off Bitter Conservative Reprisals

    Jonathan Krohn, the teen conservative idol turned liberal heretic, is on the receiving end of a world of abuse from right wing pundits this week. Fine by him. But please folks, lay off his mom.

    “My mother had a friend today who said she can’t be friends anymore because of me,” said Krohn, who described her as close to tears. “She texted her and said ‘Have a nice life.’ It’s a friend she’s known since before I was born!” Krohn told TPM Tuesday.

    Republicans had largely forgotten about Krohn since turning him into a star speaker and author in 2009 at the tender age of 13. But that didn’t mean they were happy to let him go, reacting to a Politico interview in which he said he now supported President Obama with a torrent of unrestrained rage.

    The Daily Caller led the charge. Gregg Re started things offwith a profanity-filled screed from a spurned conservative who attended Krohn’s big CPAC speech in 2009 and apparently demanded anonymity to tell Re the 17-year-old was a “douche.”

    Re then took to Twitter to snipe at Krohn for expressing his views while denying his article — “Tired Of Being Typecast As Conservative, ‘Douche’ Actor and CPAC speaker Jonathan Krohn Turns to Liberalism — was meant as an attack.

    “If I’d given a speech as devoid of thought as [Krohn] (and made money from it), I’d call myself a douche,” another Daily Caller writer, Justin Green, chimed in.

    Another Daily Caller editor, Peter Tucci, got into an extended angry sparring match with Krohn, dropping repeated references to his “hipster glasses” and throwing out such witty barbs as “Oops, I overestimated you. You’re not mature after all. I take back my praise.”

    Krohn told TPM he takes the attacks in stride. He spent much of Tuesday engaging with critics and supporters alike on Twitter, in between a stop at his grandmother’s 80th birthday and a haircut ahead of his appearance on Hardball that evening.

    “Nothing’s really stung me, all of its just so absurd,” he said. “My favorite was someone who tweeted at me ‘You betrayed God and William Bennett, you little bastard!’ Because apparently they’re on the same plateau in this person’s mind.”

      I found this very interesting. I had to take MA history way back to get my teaching cert when we lived there but I don’t remember reading anything about Elizabeth Freeman & her land mark case. But then I have forgotten more than I ever knew about a lot of things.

    I confess that I don’t get all googoo over this holiday. I heartily dislike fire works, don’t care for hot dogs & find some of the flag waving just a bit too much especially if it comes from Repugnants.

    However, I watched PBO do the ceremony for those new citizens today & cried my eyes out. It put me in mind of when my own Son-in-law got his citizenship, how proud he was, how happy we all were & how many tears of joy were shed. For anyone who has never attended one of these ceremonies, I highly recommend it if you are ever feeling too discouraged about the USA.

    The two actors (aged 63 and 53, respectively) are in negotiations to star as grandparents in Fox Searchlight’s planned film version of the Broadway musical “Black Nativity,” with Jennifer Hudson in talks to play their estranged daughter.

    Kasi Lemmons (“Eve’s Bayou,” “Talk to Me”) is writing and directing the adaptation, which centers on a young black teenager who is sent by his mother (Hudson) to spend Christmas in Harlem with the grandparents he’s never met. A sermon delivered by his grandfather, the Reverend Clarence Cobbs (Jackson), serves as the catalyst for a stylized retelling of the classic Nativity story.

    In addition to his role as the Reverend, Jackson is expected to play several different parts in the film’s Nativity sequences.

    The news was broken by Variety.

    Written by legendary novelist, poet and playwright Langston Hughes, “Black Nativity” was first performed on Broadway in 1961, becoming one of the first shows penned by an African-American to be staged there.

    The visit will be Obama’s fourth to the Midwestern battleground state, and his second campaign trip there, this year.

    Polls show the presidential contenders locked in a tight race for Iowa, which Obama carried in 2008, and is one of 12 states that could determine the outcome of the contest.

    A WeAskAmerica poll released last month showed Obama with a 1-point edge, with 45 percent support of likely Iowa voters to Romney’s 44. A poll from conservative-outlet Rasmussen, however, put Romney up 1 point at 47 percent to 46 for the president.- – -[NOTE: Rasmussen--- -HUMPH!!]

    Dang, you all, it’s RAINING here! Finally, but it is very weird. This is like our winter rains, all over cast & just a steady gentle rain. I’m not complaining. I’ll take every drop we can get! Our summer monsoons usually come in with sound, fury, a huge deluge that lasts for a few minutes & then the sun comes out again. This is really bizarre.

    I hope all is well. Sometime next week, I will post about the situation on my job – I’ll probably have to break into parts, because it’s gonna be lengthy.

    The two boards met (one in May, the other last week) and have agreed to the restructuring of the organization. I think I am OK, but we will see. I do know that the Father has been revealing to me for several months that it is time for me to move out of my position, but what hasn’t been revealed is if I will move up in my current organization or somewhere else. I’m looking forward to closure and moving ahead.

    Winfield residents upset over flier for whites only pastors’ conference

    In most situations, a flier advertising a pastors’ conference wouldn’t cause much stir, but one event in West Alabama has the townspeople of Winfield upset.

    The flier was discovered at Norris Music in downtown Winfield Monday advertising for a conference titled: “Annual Pastors Conference All White Christians Invited.”

    “It was put up throughout the town in the middle of the night. When everyone was asleep without the permission of the business owner.” Norris Music manager Tyler Cantrell said.

    According to the flier, the three-day conference ends with a “Sacred Christian Cross Lighting Ceremony.” The conference is to be held in neighboring Lamar County.

    Winfield Mayor Wayne Silas says he and other folks in town are not pleased since this event is not representative of their community in any way.

    “Business people are upset. The city is upset. The city of Winfield does not condone this,” Silas said.

    “It’s surprising to see something like that in our town,” Cantrell said. “I know it’s been here in the past.”

    The organizer of the event, Rev. William C. Collier says that his Church of God’s Chosen (Christian Identity Ministries) is not a hate group but adds that he believes “the white race is God’s chosen people.”

    Collier defends why only white Christians are invited.

    “We don’t have the facilities to accommodate other people. We haven’t got any invitations to black, Muslim events. Of course we are not invited to Jewish events and stuff,” Collier said.

    Chief Justice John Roberts is 57 years-old. If he serves as long as his former colleague John Paul Stevens, he will retire in 2048. I don’t expect Roberts to become a reliable vote for the liberal point of view on the Court, but anything that pushes him in that direction has to be considered a good thing. It doesn’t seem like he is currently welcome in the conservatives’ camp. I hope that continues. I’m sure the liberals will be happy to lunch with him today, tomorrow, and for the next few decades. Chief Justice Roberts is a human being, and he will seek positive rewards where he can find them. He may try to repair his damaged reputation with conservatives by overcompensating in future cases. Or, he may feel badly alienated and mistreated, and decide that his positive reinforcement comes from some other source. In either case, I encourage all Republicans to pile on Roberts with all the vituperative hatred and disrespect they can muster. Make life miserable for this man, please.

    Has anyone ever watched Superman IV in it’s entirety, cause I’m bout to watch it now and I honestly can’t remember what the heck is was about? I vaguely remember a “nuclear man” or something, but I still have no idea what the plot was. I’m about to find out I guess.

    Still it’s gotta be bad cause as bad as Superman III is, I still remember what the plot was.

      Is this guy the WORST presidential candidate ever? McCain wasn’t great, but at least he stuck to a position. But this guy is AWFUL. Instead of correcting his guy, Fehrnstrom, the day he said it wasn’t a tax, it was a penalty, Robme waits until now – which appears as though he had to decide which side he was on. In the meantime, more and more stories are coming out about his offshored money, The Obama campaign is whacking him with Bain’s offshored jobs. He’s a stiff. The republicans hate him. He’s a mormon and murricans are going to have a hard time swallowing it.

      And he hasn’t advanced ONE policy other than he’s going to undo what the president did.

    “You can’t just call people crooks and say that they’re committing illegal acts,” Rangel said in a speech to supporters in Harlem, according to a report in the New York Daily News.

    Rangel accused Espaillat of slandering election workers who he said were not responsible for the counting fiasco which has seen Rangel’s seeming victory in the Democratic primary two weeks ago challenged.

    “Don’t knock the system. It’s all we have,” Rangel said. “Let us improve the system if it has to be improved.”

    Reports said Rangel’s rally was attended by approximately 20 supporters.

    Well I was watching the Superman marathon on Encore Action Network, now I’m watching one of my fav lil indy movie called “Latter Days”. Hmm, I’m betting Romney is not a fan of this movie. Too bad, it’s a pretty good movie.

    Aaron Davis (Steve Sandvoss) and Christian Markelli (Wes Ramsey) are the two most opposite people in the world. Aaron is a young Elder (or a Mormon missionary) who wants to do his family proud and is quite passionate about his religion and film. Christian is a shallow WeHo waiter/party boy who only looks forward to bedding a new guy every night. After Aaron and three other missionaries move into the apartment across from Christian, his friends bet him $50 that he can’t get one of them to jump into the sack, so he instantly latches onto Aaron. There are two problems, though – Christian is falling in love with Aaron and the Mormons are not the biggest fans of the homosexual community. Once Aaron is discovered, the two have to go through trials of regret, loss, perseverance, and forgiveness if they both want to get to the thing that matters to them most: each other.

    I can honestly say that “Latter Day” regardless of the fact that it’s a “gay romance” is one of the best romance movies I”ve seen gay or not. If you are so inclined and have a night to kill, find it either on Netflix or something. It’s definitely worth it, IMHO. And even if you so not so inclined, I dare you to see it anyway and not love it.
